The High Court said on Friday that it would hear an application for a judicial review aimed at stripping lawmaker-elect Au Nok-hin of his seat on March 28.
Businessman Wong Tai-hoi claims Au supports Hong Kong independence and he should therefore have been disqualified from the Hong Kong Island by-election he won last weekend.
Wong is seeking to support his claim by noting that the pro-democracy politician set fire to a mock-up of a copy of the Basic Law at a protest in 2016.
But he dropped a bid for an interim injunction to bar Au from taking his oath of office next Wednesday, after hearing that the government has already gazetted the results of the by-elections.
Au was the pro-democracy camp's candidate for the seat left vacant when Demosisto's Nathan Law was thrown out of office by the courts for failing to take his Legco oath properly.
Au replaced Law's party colleague Agnes Chow in the race when she was barred over Demosisto's advocacy of self-determination for Hong Kong people.
