The High Court on Tuesday rejected a bail application by former Democratic Party lawmaker Andrew Wan.

Wan is one of 47 pro-democracy activists and politicians charged with conspiracy to commit subversion in relation to primary polls they held ahead of Legco elections that the government cancelled last year, citing the pandemic situation.

Prosecutors allege the group were planning to overthrow the government by winning a majority of seats in Legco and then voting down budgets.

Delivering her bail decision, Madam Justice Esther Toh said she was not satisfied that Wan would not "continue" to do things that would harm national security.

Wan's wife and children attended the hearing, as did fellow party member and co-defendant Helena Wong, who was earlier released on bail.

Eleven of the 47 are out on bail with their case due back in court on May 31.

The national security law Beijing imposed on Hong Kong last summer has removed the traditional presumption of bail for non-violent offences.
